Article 1 - DEFINITIONS
The following terms have the following meanings in these general terms and conditions:

  • Entrepreneur - The natural or legal person acting in the course of their trade, business, craft, or profession, identified as follows:

  • Consumer - The buyer who acts for purposes outside their trade, business, or profession.

  • Parties - The entrepreneur and the consumer.

  • Offer - The products, services, or digital content offered by the entrepreneur for sale to the consumer.

  • Purchase - The product, service, or digital content purchased by the consumer from the entrepreneur through the purchase agreement.

  • Cooling-off period - The period in which the consumer has the right of withdrawal.

  • Day - Calendar day.

  • Right of withdrawal - The right for the consumer to terminate the purchase within the cooling-off period.

  • Purchase agreement - The agreement in which the entrepreneur commits to providing an item and the consumer commits to paying a purchase price for it.

  • Distance purchase - A purchase agreement concluded between the entrepreneur and the consumer within the framework of an organized system for selling goods or services remotely, without simultaneous physical presence of both parties, using one or more remote communication methods.


Article 2 - APPLICABILITY

  1. These general terms and conditions apply to all distance purchase agreements concluded between the entrepreneur and the consumer.

  2. Before concluding the purchase agreement, the general terms and conditions will be made available to the consumer in such a way that they can be stored by the consumer.

  3. If additional or deviating conditions apply to the purchase agreement, these will be provided in the same manner.

  4. In the event of conflicting additional or deviating conditions, the most favorable terms for the consumer shall apply.


Article 3 - PURCHASE AGREEMENT

  1. The distance purchase agreement is concluded when the consumer accepts the entrepreneur’s offer.

  2. The offer is described fully and truthfully by the entrepreneur, including applicable conditions.

  3. The entrepreneur informs the consumer about their rights and obligations related to accepting the offer.

  4. The entrepreneur clearly and legibly states any delivery limitations and accepted payment methods at the beginning of the order process.

  5. Upon concluding the agreement, the entrepreneur provides the consumer with the following information: a) The identity, mailing address, phone number, and email address of the entrepreneur. b) The main characteristics of the purchase. c) The purchase price, including all taxes and delivery costs. d) The method of payment, delivery, and execution, including any related terms and costs. e) The entrepreneur’s complaint handling policy. f) If applicable, the right of withdrawal conditions, period, return procedure, and reimbursement details, including a withdrawal form. g) If the right of withdrawal is excluded, the entrepreneur must clearly state this before the agreement is concluded. h) A reminder of the legal warranty ensuring that the purchase must conform to the agreement. i) If applicable, the duration and termination conditions of the agreement. j) If applicable, the existence and conditions of financial guarantees required from the consumer.


Article 4 - RIGHT OF WITHDRAWAL

  1. The consumer has a 14-day cooling-off period to withdraw from the agreement without giving reasons.

  2. The cooling-off period starts the day after the consumer receives the product.

  3. For multiple products in one order, the cooling-off period starts the day after the last product is received.

  4. If the purchase consists of multiple shipments, the cooling-off period starts after the final shipment is received.

  5. The consumer may use the provided withdrawal form or another clear statement to withdraw.

  6. If the required withdrawal information is not provided, the cooling-off period is extended by up to 12 months.

  7. The right of withdrawal does not apply in cases such as: a) Products with price fluctuations beyond the entrepreneur’s control. b) Public auction purchases. c) Urgent repair or maintenance services requested by the consumer. d) Custom-made or personalized products. e) Perishable goods with a limited shelf life. f) Hygiene-sensitive products with broken seals. g) Alcoholic beverages with a delivery period exceeding 30 days. h) Unsealed audio, video, or software products. i) Newspapers, magazines, or periodicals (except for subscriptions).


Article 5 - TERMINATION

  1. If the consumer exercises the right of withdrawal, the agreement is terminated.

  2. The entrepreneur must refund all payments, including shipping costs, within 14 days.

  3. The refund is made using the same payment method unless the consumer agrees to another method.

  4. If a more expensive shipping option was chosen, the additional cost is not refunded.

  5. The consumer must return the product within 14 days after withdrawal notification.

  6. Return shipping costs are borne by the consumer unless otherwise stated by the entrepreneur.


Article 6 - PRICE

  1. Prices are in euros and include VAT.

  2. Price increases after the agreement are not allowed unless the consumer has the right to terminate the agreement.

  3. The entrepreneur reserves the right to cancel an order in case of an obvious pricing error.


Article 7 - PAYMENT

  1. The entrepreneur may require an advance payment of up to 50% of the purchase price.

  2. The remaining payment must be made within two days after the cooling-off period ends.

  3. If payment is not made on time, the consumer is in default and may be charged interest and collection costs.


Article 8 - DELIVERY

  1. The entrepreneur ensures careful delivery to the address provided by the consumer.

  2. The risk transfers to the consumer upon delivery.

  3. Delivery occurs within 30 days unless otherwise agreed.

  4. If the delivery time is exceeded, the consumer may cancel the agreement and receive a refund.


Article 9 - WARRANTY

  1. The entrepreneur ensures that the purchase conforms to the agreement.

  2. Any seller or manufacturer warranty does not affect the legal warranty.

  3. The warranty does not cover normal wear and tear or damage caused by improper use.


Article 10 - COMPLAINTS AND DISPUTES

  1. Dutch law applies to all agreements between the parties.

  2. The entrepreneur has a consumer complaint handling procedure.

  3. Complaints must be submitted promptly and clearly described.

  4. The entrepreneur responds to complaints within 14 days.

  5. If unresolved, disputes may be referred to the competent court.
